Case-handling support for agencies and municipalities.
The Administrative Procedure Act, the Public Access and Secrecy Act (OSL), GDPR and data protection – support for case officers in the public sector who need quick access to law, legislative history and case practice from the Parliamentary Ombudsman (JO) and the administrative courts.
The most common questions
The questions we see again and again from users in this role.
How thoroughly must we justify a rejection?
Section 32 of the Administrative Procedure Act (FL) – decisions unfavourable to a party must be reasoned. Boilerplate phrases are not enough; JO regularly rejects 'pro forma' justifications.
When does secrecy apply in personnel matters?
OSL chapter 39 – strong secrecy for information about personal circumstances. The harm test is 'reversed' (secrecy is the default).
Can we use AI tools in case handling?
Yes – but documentation requirements, the right of parties to review the case file, and the ban on fully automated decisions (FL section 12, GDPR Article 22) set limits.
What is required for communication under Section 25 FL?
A party must be given the opportunity to comment on all material added to the case by others. Failures here often lead to JO criticism and overturned decisions.
