Patents Act:
s223A Computerised decision-making
Sec 223A allows the Commissioner a broad discretion to implement computerised decision-making to assist or comply with her duties under the Patents Act. As the Explanatory Memorandum explains, the provision is not intended to be limited to specific decisions or obligations but should broadly encompass developments in technology and the increasing number of decisions suitable for computerisation. Any computerised decision under the Commissioner’s control is considered to have been made by the Commissioner.
A computerised decision can be appealed or reviewed in the same way as if it had been made by a person.
