An application for registration must include:
a valid address for the applicant;
an address for service; and
the name and address of any representative or agent, if applicable.
An applicant may also provide a separate address for correspondence.
Valid address
A valid applicant address may be:
a residential address;
a business address;
a post office box (PO Box); or
a roadside mailbox (RMB).
Address for service
The address for service is the address to which the Registrar will send correspondence relating to the application and any resulting registration (reg 11.19 ).
An application must include an address for service located in Australia or New Zealand. At this time, the address for service may only be a postal address.
Where the applicant is not represented, the address for service will usually be the same as the applicant's address. In these circumstances, the applicant may indicate the address for service by stating "as above".
Joint applicants must nominate a single address for service, as the Registrar sends only one copy of correspondence.
If an application does not include an address for service, or it is unclear whether an address for service has been provided, a written notice should be issued requesting the applicant to provide a valid address for service.
A contact telephone number for the applicant or address for service should be provided where possible.
Representative or agent
Where an applicant is represented by an agent or attorney, the representative's name and address should be provided. The representative's address will ordinarily constitute the address for service.
All correspondence must be sent to the address for service, regardless of whether alternative contact details appear elsewhere in the application or supporting documents.
Address for correspondence
An applicant may provide a separate address for correspondence. Unlike an address for service, an address for correspondence is not required to be located in Australia or New Zealand.
Where no address for correspondence is provided, correspondence will be sent to the address for service.
If an applicant subsequently provides correspondence details that are inconsistent with the details recorded on the application, and no formal request to change the relevant address has been made, clarification should be sought before the records are amended.
